Seezi respects your privacy. Our Privacy Policy explains how we collect, use, share and protect Personal Data from or about you in connection with your use of the Seezi Service.

If you are a resident of a country that is part of the European Economic Area  , the United Kingdom or Switzerland (collectively the "  EEA " unless otherwise expressly stated herein), references to "  Seezi", "  we  ", "  us  " or  "our"  in this Privacy Policy  refer to "Seezi", the details of which are provided herein .

If you reside in a country outside the EEA, references to “Seezi”, “we”, “  us  ” or “  our” in this Privacy Policy will always   refer to “Seezi” as detailed herein .

We encourage you to read this Privacy Policy carefully when using the Seezi Service or transacting business with us.

DEFINITIONS

Unless otherwise defined in this Privacy Policy, any capitalized term shall have the meaning given to it in the Seezi Terms of Use  .

For the purpose of this Privacy Policy, the terms “ Seezi Service  ” or “  Service ”  shall include the Seezi Service as defined in the Terms of Use  and the websites other than ‘seezi.net’ operated by Seezi (“  Secondary Sites  ”).

The term "Commercial Partner  " refers to legal entities with which Seezi may cooperate in operating its Service. In particular, Commercial Partners  may include Selected Commercial Partners, Data Partners  , content creators, advertisers, media agencies and other actors of the online marketing industry, as well as Seezi's affiliates.

The terms “  Personal Data  ”, “  Data Controller”,  “  Joint Controller”,  “  Data Processor  ” and “  Processing  ”  as used in this Privacy Policy shall have the same meaning as defined in the General Data Protection Regulation  (“  GDPR”) or the meaning provided to equivalent terms in applicable local data protection laws. Personal Data processed by Seezi  shall be referred to as “Data”.

The term “ Seezi Company  ” refers to any affiliate of Seezi that is a subsidiary of Seezi.  

1.  General Information

1.1. Seezi’s Role in Processing Personal Data

 Certain Data may be collected from or about You or otherwise processed when you use the Seezi Service, regardless of whether you use it as a Viewer, Visitor, User or Partner ( as defined in the Seezi Terms of Use ).

If you reside in a country that is part of the European Economic Area  , the GDPR applies to the collection of your Personal Data. If you reside outside the European Economic Area, local privacy laws apply to such collection, usually the laws of your country of residence.

Seezi   becomes the Data Controller when we process your Data for the purposes we have defined and using the tools we have chosen.

We may contract with certain service providers to assist us in carrying out certain aspects of your Data Processing. In doing so, these service providers act on our behalf, following our instructions, and are therefore considered to be our Data Processors.

When Seezi and its Business Partners process your Personal Data together for a common purpose and using tools we have chosen together, Seezi becomes a Joint Data Controller.

Our Business Partners (or the relevant Data Processors) are independent Data Controllers when they process your Personal Data for purposes they independently define and using tools they define. Subject to applicable local laws and available technical protocols, Seezi's role is limited to collecting and communicating your consent on behalf of these Business Partners and providing you with access to their respective privacy policies and consent management mechanisms. 

Seezi becomes a Data Processor if Seezi participates in the implementation of certain Personal Data Processing operations carried out by our Business Partners and remains a Data Controller  .

In particular,  if Your Content includes Third Party Personal Data (for example, a video You upload to the Seezi Service that includes images of a friend of Yours), Seezi is Your Data Processor. Further details on these processing operations  are available in Appendix B of the Terms of Use  .

1.2. Legal Reasons for Processing Personal Data

1.2.1.  Legal Basis

The GDPR provides several legal bases that Seezi may rely on for the Processing of Personal Data, namely consent, contractual obligation, compliance with a legal obligation, vital interests of data subjects, public interest or legitimate interest. Similarly, applicable laws may provide for equivalent or additional legal grounds, as further explained in the country-specific paragraphs in Section 8.

Since our Service is provided to You through different digital properties, namely the Seezi website and application and our Video Player embedded on third party websites or applications, the Processing of Your Personal Data and the applicable legal basis differs depending on the part of Our Service You use.

When you access our Service through the Seezi website and app  , we rely on the following legal basis when processing your Personal Data.

  • Contract: Whenever processing of your Personal Data is necessary to provide our service to you, including when you choose to use our optional features, we rely on contract. In particular, we rely on contract when we process your Personal Data for the following purposes:
    • Display of Content and Advertisements: The Seezi Service offers access to Content associated with advertisements.  The existence of both Content  and advertisements is a fundamental and integral part of our Service. As a result, we rely on contract as the legal basis when we use your Personal Data to display Content and advertisements.
    • Content recommendation: The presence of relevant Content is a fundamental feature of our Service. As a result, the processing of your Personal Data by our content recommendation tools is contractual.
    • Use of our Service: We process your Personal Data to prevent unauthorized access to our Service, including bots, and to enable you to use our Service features. For example, when you upload videos, we store your Content and if you are eligible to receive payments from us, your payment details and information related to the amount to be paid are used by us to process such payments.
    • Account creation and management: Your email address, password, age and username are mandatory elements of each account. The processing of these account credentials and related information for the purpose of managing your Account is contractual.
    • Respect for the obligations of the parties under the agreements in force between you and Seezi. By accessing our Service, you accept our Terms of Use, meaning that you have entered into an agreement with Seezi. In general, we rely on contract when the processing of your Personal Data is necessary for the execution of this agreement.
  • Legitimate interest: We rely on legitimate interest when our processing of your Personal Data is based on our interests or those of you or third parties (e.g. other end users of our Service, advertisers, etc.). For example, we rely on legitimate interest when we process your Personal Data for the following purposes:

    • o Mandatory communication: In some cases, we are legally obligated to send you information by email or other means. For example, if your Content is moderated, we are required to notify you. As a result, when we use your email to send such notice, we do so to comply with our legal obligation.
    • o Security: various laws impose security obligations on services like ours. For example, the GDPR imposes an obligation on organizations that process personal data to implement adequate security measures that protect the processed data, without necessarily ensuring that breaches do not occur. When we use your Personal Data for these security measures, we do so to comply with our legal obligation.
  • Consent: When processing your Personal Data, we rely on your consent to determine what interests you have and to show you advertising that is relevant to your interests. We also ask for your consent to share your Personal Data with third parties when there is no pre-determined legal basis for such disclosure.

Where Processing of your Personal Data is based on consent, we will require you to communicate your consent by a positive action (for example, by clicking the "Accept" button on our Site, Secondary Site or Video Player or by any other means in compliance with applicable law). Where Processing of your Personal Data is based on legal grounds other than consent, we will inform you of the applicable legal grounds and, where applicable, provide you with the means to object to it.

1.2.2.  Transparency and Approval Framework

For GDPR compliance purposes, Seezi  participates in the “Transparency and Consent Framework” developed  by Interactive Advertising and follows its Terms and Policies.

If you visit websites or apps, cookie banners are used to save your privacy preferences for these publishers, Seezi and other organisations selected by its publishers.

1.2.3. Refusal or Opposition to Processing

When the Processing is based on consent or legitimate interest, you may always choose not to consent to the Processing of part of your Data, to withdraw your consent or to oppose such Processing (unless applicable law authorizes us to disregard this decision) as further explained herein. However, this may limit your ability to fully enjoy the many features we offer and may consequently impair your user experience. In addition, the Seezi Service offers Visitors access to a large number of videos without charging a corresponding fee. This is only possible by associating advertisements with the available videos and by financing our Service through means other than access fees.  THE SEEZI ENTERPRISE SOLUTION VIDEO PLAYER, CONTENT AND ADVERTISEMENTS ARE INTEGRAL PARTS OF OUR SERVICE, AND THE SEEZI SERVICE CANNOT EXIST WITHOUT ANY OF THEM. YOUR CONSENT TO THE PROCESSING OF YOUR DATA WILL NOT ELIMINATE OR LIMIT THE NUMBER OF ADVERTISEMENTS SHOWN TO YOU; THIS MAY ONLY RESULT IN ADVERTISEMENTS THAT ARE MORE REPEATED AND LESS INTERESTING TO YOU  .

2.  Data we collect

We may collect Personal Data that can directly identify you, such as your name and email address, and other information that does not directly identify you. This Section explains what Personal Data we collect (2.1) and how we collect that information (2.2).

Please note that we may collect Data about yourself during your use of the Seezi Site and Seezi Apps or when you use our Video Player embedded on third-party websites or third-party applications.

2.1. Categories and Sources of Data We Collect

2.1.1. Data You Provide to Us

We collect Personal Data that you provide to us when you interact with the Seezi Service, register for an account, upload Content, create a playlist, or share a playlist with others. For example, when you register to use the Seezi Service, you may provide your name, email address, date of birth, gender, and other similar information. If you are a member of the Seezi Partner Program, Seezi may also collect your payment information, such as your address, bank account or online payment system details, and authentication information, and, depending on the payment system you choose, your billing and contact information. Please note that we do not collect your credit card information. Seezi may also collect information that you provide to us when you respond to surveys, set preferences on the Seezi Service, contact Seezi directly through the Seezi Help Center   or otherwise, or agree to participate in promotions that Seezi may offer from time to time. To help you manage your account access rights, Seezi allows the creation of multiple login accounts under a single Partner account. As a result, we may collect the information you provide to us if you create such login accounts.

2.1.2. Usage and Log Data

We collect information when you use the Seezi Service or watch Seezi advertisements outside of the Seezi Service. Additionally, subject to your permissions, we may collect information from and about the computers, phones, tablets, or other devices on which you install Seezi Apps or otherwise access the Seezi Service. Such information may include your IP address, device ID, settings of the browser and operating system you use (such as the type and version of an operating system or language settings), your activity on the Seezi Service, including information about videos you watch on the Service (such as video titles and categories), advertisements served to you and your interaction with them, frequency and duration of your activities, page views, referring URLs, network status, and carrier information.

2.1.3. Data Provided by Third Parties

  • Account Data from Third Party Services 

If you choose to log in, access or otherwise connect to the Seezi Service or communicate with Seezi through a third-party service (e.g. Google), this method is completely optional and subject to your sole discretion, and we may collect your email, gender, birthday and other information you make public through that service in order to fulfill your choice of a login or communication method. Depending on the third-party login service used and applicable application policies, we may also collect additional information that you authorize the third-party service to share with us (e.g. your user ID, billing information, etc.).

If you are eligible to receive payments through our Service and choose to integrate an account you have with one of our payment solution service providers, we will receive the payment account details corresponding to your account.

  • Third Party Data

Subject to your consent or if otherwise authorized under applicable law, we may receive information about you from some of our Data Partners. Your data may be disclosed to us by our Business Partners and  shared with us by our selected Business Partners  .

The data shared (whether de-identified, pseudonymized or anonymous and collected online or offline) may include information about your interests, demographic data, purchasing behavior and online activities (such as the websites you visit and/or advertisements you view).

We may combine the shared information with information we have collected from or about You and use it as described in Section 3 of our Privacy Policy or as permitted by law.

2.2. How is Data Collected?

2.2.1. Collection of Data through the Use of Technologies

As with many online services, we use a variety of technologies, either directly or through our subcontractors, to collect usage data and store your user settings. The Data collected in this way helps us recommend, maintain and improve the Seezi Service and personalize your user experience, for example, by providing you with access to videos in a language that corresponds to your browser settings or in a format compatible with your device.   

Despite the variety of actual measures implemented, the various technologies used to collect data are commonly referred to as "  cookies  " or "  trackers  " and their use is regulated by "cookie laws." Where applicable laws make the use of cookies subject to user consent, Seezi will ask for your consent before using them.

A "cookie" is a small data file that is downloaded to Your Device. The lifespan of a cookie is limited by its purpose and generally does not exceed 13 months. A cookie expires at the end of its validity period, unless you use the so-called "refresh" feature. It may be deleted by You or by the technologies You use (for example, Your browser) before its validity period expires.

Below you will find a general representation of the types of trackers we use. You will find information about the use of cookies in connection with advertising on the Seezi Service in Section 3; we recommend that you read our Cookie Policy to learn more about our cookie management rules   .

Depending on your country of residence, you can manage your cookie settings at any time and choose the purposes for which you allow or reject the use of cookies by accessing the “ Manage Cookies ” section , accessible within the EEA from the footer of our website and the settings of our app   .

  • Cookies and Local Storage

We may use both session cookies and persistent cookies to provide you with a high quality Service, to better understand how you interact with the Seezi Service or with marketing materials promoting the Seezi Service outside of our Service; to monitor aggregate usage and web traffic routing by our users on the Seezi Service; to use technical and automated tools to display Content and advertising based on your data; to respect the rights of content rights holders or advertisers, and to comply with obligations imposed by applicable laws. We may create a unique device or user ID for you (“Service ID    ) and store it in a cookie so we can customize your experience based on your preferences. These uses allow us to create a better experience for you on the Seezi Service.

 We may collect information through other types of local storage (also called " Flash cookies ") and HTML5 local storage, including in connection with features such as volume/mute settings for the Video Player  .

Most Internet browsers automatically accept cookies. You can instruct your browser to stop accepting all or some cookies, or to prompt you before accepting a cookie from the websites you visit, by changing your browser settings. For more information on disabling cookies or deleting information contained in cookies in general, see our Cookies Policy. Please note that disabling cookies or deleting information contained in cookies or Flash cookies may affect the performance and features of the Seezi Service, including the Video Player. For example, we may not be able to store your preferences (such as the language to be used by the Service) or your login information (such as keeping your connection session active so that you are automatically recognized by the Seezi Service when you access it repeatedly from the same device), or use technical means to display Content and advertising based on your online viewing habits.

  • Web Beacons, Pixels and Other Trackers

Web beacons or pixel tags are similar to cookies and can be placed on web pages, videos or emails. These technologies are used primarily to learn whether you viewed a particular web page, advertisement or email message; and to determine other usage details, including the time and date you viewed the Content, the IP address of your computer and the URL of the web page from which the Content was viewed.

  • Mobile Device Identifiers and Software Development Kits (“SDKs”)

We may use or work with third parties, including our Business Partners and service providers, who use mobile SDKs to collect information such as advertising identifiers (for example, “advertising ID” or “IDFA”) and information about how mobile devices interact with the Seezi Service. An SDK is computer code that app developers can add to their applications to enable the display of ads, collection of data, and implementation of related services and functionality (a mobile SDK is a mobile application version of a pixel tag or beacon, as described above). For example, we may use this technology to analyze how you interact with Content and ads and to enable analytics or other features through mobile devices.

2.2.2. Data Collection Through Other Tools

We may receive data directly from You (e.g., when you open an account, complete a survey, or contact our Support Team), from some of our Data Partners (e.g., general information about your interests inferred by our Data Partners when you use their services or the services of third parties), or we may infer certain information about You based on information we have.

3.  PURPOSES OF DATA PROCESSING

3.1. Purposes of Data Processing by Seezi

3.1.1. General

We process Data directly or through our service providers to create an engaging and relevant experience for our users and to ensure that the rights and interests of Content rights holders and advertisers are respected. We may share some of your data with our Business Partners to operate and improve our Service and to better understand what may be of interest to you.

We use all information legitimately collected or received, no matter how diverse, to help us provide and support the Seezi Service with a first-class user experience tailored to each user's taste. The way we use Data About You depends on how you use the Seezi Service.

Please note that the videos accessible on our Service, whether Content or video ads, are not owned by Seezi. They are provided by various rights holders who, by sharing their videos on the Seezi Service, decide which of their videos they will make available to You. They cover a variety of topics, are in multiple languages, and are accessible from a variety of electronic devices and through different browsers. As a content hosting platform, Seezi does not curate the videos that You will access. This means that we do not have a team of content editors who present a selection of Content that we believe will suit your tastes. Instead, we use automated technologies to adapt Content and ads to the technical characteristics of your device (for example, to show you videos in a format compatible with your device and in the language of your browser) and to your interests.

You will find detailed information on the purposes for which your data is processed in this Section.

3.1.2. Purposes of Data Processing

Seezi may process Data for the following purposes:

  • Provide the Seezi Service.  We use your Data to provide the Service, namely to display Content and ads and to enable you to use every feature of our Service. For example, we collect your authentication data to allow you to connect to your account. We collect your technical specifications to deliver a video in a format that works on a device you use. If you upload Content to our Service, we use your Data to provide statistics on how your Content performs. If you use our monetization feature, your Data is used to track your revenues. Our algorithms use information about the Content you access and how you interact with our Service, along with other data, to suggest Content that may be of interest to you.
  • Improve, Enhance and Understand the Seezi Service and our Audience  . We process your data to understand how our Service is used and interacted with, and ultimately to provide the best user experience we can to our end users. We may conduct surveys and research to learn what is expected from our Service. We analyze the information we have, evaluate and improve our current products and services, and develop and test new offerings or features to keep up with technological evolution and maintain the quality our end users expect from our Service. We diversify our revenue sources and implement cost-cutting measures to keep final service fees to a minimum and, in particular, to maintain free access to Content hosted on our Service.
  • Communicating with You.  We may use your information to send you newsletters and marketing communications, to communicate with you about the Seezi Service, and to notify you about changes to our Service’s legal terms and policies. We also record any privacy preferences you have communicated to us. We may use your information to respond to you when you contact us or for any other purpose disclosed to you at the time we collect the Data or related to a request made by or about you. For information on opting out of promotional communications, please see the information we provide in Section 8 (“Your Privacy Rights”) below.
  • Show and Adapt Ads.  Seezi offers its users the opportunity to watch a large number of videos without charging any fee in return. Such a free service is only possible thanks to the existence of ads and other alternative revenues. We may use the Data we have, including information from our Business Partners, to evaluate and improve our advertising and analytics systems so that the ads shown to You on and outside of our Services are customized and of real interest to You. We also use Data to limit the amount of ads shown to You on our Service to ensure that You fully enjoy the Content. We also measure the effectiveness and reach of ads and services by processing some of your Data. Your Data may be shared with our Business Partners or some of our Data Partners to inform them about your decision to allow the processing of your Personal Data and, depending on the existence of the applicable legal basis, to allow them to estimate whether the product or service for which they are running advertising campaigns is of interest to You. To learn about interest-based or online behavioral advertising, please see the information we provide in Section 8 below ("Your Privacy Rights") or use your preferences accessible within the EEA in the "  Manage Cookies  " section of Seezi, in the footer of our website and in the settings of our app.
  • Get Paid to You.   If you are a member of the Seezi Affiliate Program, we will use your billing information, such as your billing address or payment method details, to process amounts generated under our Affiliate Program monetization features. If you select a third-party payment method, we will transmit all information necessary to process payments due to your selected payment service provider and may obtain the recipient account details and related payment confirmations from such payment service provider. The exact information transmitted or received depends on the selected payment service provider, the amounts to be paid, and the then-current requirements of the laws and regulations applicable to financial transactions. Please note that we do not use or otherwise access your credit card information.
  • Determine Your Geolocation.  We may collect location data (limited to the city level only) from your device. This information not only allows us to provide Content that is relevant to your local area, such as local news and sports videos, but also ensures that Content geographic restrictions imposed by Content rights holders are respected. This Data may also be used to tailor advertising to you based on your location, for example by not showing you ads for services that are not available in your location. 
  • Detailed Aggregated or Anonymized Statistics.   We may “de-identify” your and/or other users’ information, meaning that the Data is altered (anonymized or combined with other information) and no longer personally identifies You. We may then use this “de-identified” information for any legitimate internal and external business purpose, including research and analysis of the Seezi Service, improving our ability to deliver customized advertising, and promoting our Service to future users, Business Partners, and other business partners. In particular, we may share your aggregated Data (i.e., information in a form that does not permit its recipients to identify You) with advertisers and Content owners to provide them with meaningful insights about the audience of their advertisements or Content on our Service.
  • Ensure the Safety and Security of the Seezi Service and Compliance with Applicable Laws.   We may use Data to ensure the security and anti-fraud protection of our Service. Our dedicated engineering teams do this using automated procedures and advanced technologies such as data encryption and machine learning. As a result, your Data may be processed as part of an investigation of suspicious account activity or violations of our legal provisions and policies. In accordance with our legal obligations, Seezi maintains connection logs related to each User's account activities and transmits them to duly authorized public authorities upon request pursuant to applicable legal procedures.
  • Share Your Data.  The operation of our Service may require sharing of Your Data. Data Sharing is not a purpose in itself, but serves different purposes underlying our relationship with the entities to which we disclose Your Data. For example, in general, the delivery of digital ads requires the disclosure of some of Your Personal Data to companies involved in the ad serving process (e.g. advertisers, agencies, technical facilitators, etc.). The amount and type of Data disclosed depends on whether You have consented to the display of targeted ads. We may also share Your Data  with Selected Business Partners (some of whom are our Affiliates) with whom we work closely  . We do this to better understand what interests You and to provide You with better services, Content, and ads that are of interest to You. Some of Your Data may be disclosed to some of our Data Partners for further use to promote the development of artificial intelligence.

3.1.3. Specific Purposes for which Data is processed when running the Enterprise Solution Video Player

We are constantly working to improve the Seezi Service, including developing different versions of our Video Player. As part of this effort, Seezi may, subject to certain financial terms, offer content partners the ability to use our Video Player to distribute Content without any association with advertising (“  Enterprise Solution Video Player  ”).  

Content Partners who choose this new solution (“  Customers  ”) integrate this Enterprise Solution Video Player into their own websites or other digital properties (for example: mobile applications) and choose the Content they want to present to You.  

When customers use the Enterprise Solution Video Player, Seezi remains the Data Controller for the cookies deployed by this player and the related processing of your Personal Data. Since the Enterprise Solution Video Player is not designed to display advertising, Seezi does not use advertising cookies or process your Personal Data for advertising-related purposes. For more information about the cookies used by the Enterprise Solution Video Player, please  see our Cookie Policy  .  

When you watch Content made available by Customers through the Enterprise Solution Video Player, you are visiting the digital properties of those Customers (for example: their websites or mobile applications). As a result, cookies other than those used by our Enterprise Solution Video Player may be deployed by those Customers or the third parties they work with. Seezi has no control over the use of these cookies and the data they collect. For more information about the cookies used by Customers and the third parties they work with, and the corresponding processing of your Personal Data, please refer to the privacy and cookie policies of the digital properties of the Customers you visit.  

3.2 Purposes of Data Processing by Our Commercial Partners

3.2.1. Processing Directly Related to Your Use of the Seezi Service

When you view Content or advertisements on the Seezi Service, our Business Partners, directly or through their respective subcontractors, may collect and further process information about you and your use of our Service. They may use this information, together with other data they have access to, to tailor content and advertisements that may be displayed to you on our and third-party services. In doing so, our Business Partners process your Personal Data in their capacity as Data Controllers and in accordance with their own privacy policies.

When ads are displayed to You on our Service, certain Data is disclosed or collected by our Business Partners in accordance with industry standard technical protocols to allow the delivery of an ad on the device you are using or for other ad-related purposes (e.g. security, ad measurement, service improvement, etc.). This Data may include your digital identifiers, information about your Device and its settings, the URL of a website, the content you are viewing and the associated ad, your approximate location, the socio-demographic or interest-based category we believe you belong to (based on information we collect from you or about you and/or third parties), and your privacy preferences. We may share additional data with advertisers. For example, data about ad performance (e.g. how many times it was viewed, clicked, or otherwise engaged with) or general demographic information about the ad audience (e.g. the age range, gender, and location of those most frequently viewing their ads (e.g. female between the ages of 25 and 30, living in New York)). The actual categories of Data disclosed or collected and the purposes for which they are used depend on your use of our Service, the terms of our cooperation with our Business Partners, the technical protocol used and, where applicable, your actual privacy preferences.

Seezi works with a large number of advertising-related Business Partners. Their lists are published on our Service and can be consulted at any time in the "Manage Cookies" section accessible within the EEA from the footer of our website and in the settings of our application. Please note that this does not mean that all of these Business Partners process your Personal Data when you visit our Service. Only the Business Partners (or technical service providers) involved in delivering the advertisements shown to you or the Content you watch on the Seezi Service process your Data. The identity of the Business Partners processing your Data depends on the Content and advertisements you watch on our Service.

3.2.2. Remaining Process

In operating the Seezi Service, we may disclose or share Your Data with our Business Partners. In particular, we and  our Selected Business Partners  may share information we have about You to learn more about Your tastes and to enable each of us to provide You with more personalized services, products and advertising. 

Additionally, from time to time, we may disclose some of your Data to selected Data Partners for use in training general purpose Artificial Intelligence. If we do so, and where required by applicable law, we will provide you with the opportunity to object to such disclosure of your Personal Data.

3.2.3. Roles and Responsibilities of the Parties

When the Disclosed Data is used by a Business Partner for its own purposes, such Business Partner is the Data Controller in relation to the Transaction it performs .

As the Data Controller, each Business Partner determines the purposes for which it wants to process your Personal Data. These purposes may include developing, improving and providing its services, targeting audience and service analytics, personalizing and adapting its content, commercial offers and advertising on or outside the Seezi Service to your interests, compliance with relevant contractual and legal obligations, such as geographical restrictions on content usage rights, calculation of applicable fees or fraud prevention measures. To learn more about the purposes and legal grounds of Business Partners' Processing in relation to advertising, you can access their records or privacy policies through the links in the "Manage Cookies" section accessible from the footer of our website and the settings of our application.

When our Business Partners’ collection or processing of your Personal Data is based on your consent, Seezi requests such consent from you on behalf of our Business Partners. Consequently, you can manage your privacy preferences regarding the collection or processing of your Personal Data by our Business Partners at any time in the “Manage Cookies” section accessible from the footer of our website and in the settings of our application. You can also exercise your rights by accessing the relevant privacy policies of the Business Partners accessible from this section.

Due to the inherent dynamic nature of online activities, the Seezi Business Partners list may evolve and we invite you to consult this list regularly for the most up-to-date information.

Please note that declining to use your Personal Data for ad targeting purposes will not prevent ads. You will still see ads, but they will be less relevant to your interests.

4.  DATA RECIPIENTS

We may share personally identifiable or non-personally identifiable information collected from or about you with third parties or allow you to share personal information with third parties, such as social networks, as described in more detail below ("  Data Recipients  "). We require such Data Recipients to abide by strict confidentiality obligations consistent with this Privacy Policy and any agreements we may enter into with them.

4.1. Third Party Login Services

If you connect to the Seezi Service through a third-party login system (e.g. your Google or Apple account), you may be choosing to share information about your activities on the Seezi Service with that third party. In addition, if you visit Seezi while logged into their account, those entities may record your browser details and combine technical information from your web browser with other information that each of them already knows about you. Your decision to share information about your activities on the Seezi Service with those third parties may result in Seezi sending that information about you to those third parties, who may then use that information in accordance with applicable law, their own data and privacy policies, and your privacy settings, or make it visible to their users. We encourage you to familiarize yourself with the relevant data and privacy policies and existing account privacy controls of those third parties. We remind you that Seezi is independent of those third-party companies, and that any privacy settings you may have selected on the Seezi Service do not apply to such third-party sites.

4.2. Commercial Partners

We work with a number of Business Partners who help us provide and improve the Seezi Service. Business Partners  include Selected Business Partners  ,  Data Partners  , Content uploaders and advertisers and other players in the digital industry. We may disclose information collected from or about You to these Business Partners (or their authorized service providers) when legally authorized to do so, but such disclosure is always accompanied by appropriate technical, organizational or contractual measures intended to ensure the integrity and security of Your Information (e.g., aggregation, anonymization, etc.).

In particular, we may share information about You, usually in aggregated, encrypted or anonymized form, with advertisers and advertising service providers for the purposes described in Section 3.2 above (for example, to deliver advertising videos), to make advertising relevant and interesting to You or to measure and improve the effectiveness of advertising campaigns or to support the development of new technologies, including artificial intelligence. Please note that we do not share directly identifiable information about You (such as your email address) with advertisers and advertising service providers.

4.3. Service Providers

4.3.1. General

Like most companies, we contract with third parties to provide us with specialized services in connection with our business activities. The services we contract for change and evolve over time and include: payment solutions, analyzing and processing data (for example, providing analytics software that helps us improve the relevance of advertising), hosting our websites and Content, providing customer support, communicating with you (for example, via email or push notification systems), or otherwise helping us provide the Seezi Service.

When the provision of these services requires it (and you have consented to it or we are otherwise authorized to do so), we share some of your Data with our Service Providers. Our Service Providers are committed to confidentiality obligations in accordance with our current Privacy Policy and the agreements we have with them.

4.3.2. Audience Measurement Providers

Our Business Partners, such as content providers and advertisers, seek to measure the performance of their videos across multiple platforms, including the Seezi Service. Accordingly, Seezi may use and permit the use of independent, industry-standard, third-party measurement solutions (such as Nielsen or comScore) on its Service, which may enable us or our Business Partners to include Your video views in or on our own measurement statistics. We may also share our own usage statistics with these Business Partners in an anonymized or aggregated form.

To learn more about your choices regarding audience measurement software, please see the information we provide in Section 8 (“Your Privacy Rights”).

4.5. Public Authorities and Legal Advisors

In some cases, we may be required to disclose information from or about You to public authorities or legal counsel without providing You with notice or an opportunity to object. We may disclose Your Information in good faith to protect the legal rights of Seezi, our affiliates or Business Partners and each of our stockholders, directors, officers, employees or agents, and our technical service providers acting as our processors or subprocessors; to protect the safety and security of our users or third parties;  to enforce our Terms of Use  ; to prevent fraud; for risk management purposes; and to comply with or respond to the law, a legal process or a request for cooperation from a government agency. However, Seezi's policy is to promptly notify you upon receipt of a subpoena, court order or other document requesting Your Data, when reasonably possible and legally permissible, so that You have a sufficient opportunity to bring appropriate legal action.

Additionally, if you notify us that you believe your legal rights have been violated by Seezi or another user of the Seezi Service, we may provide the Data you have provided to others to the extent we believe it is necessary to evaluate and respond to your complaint.

4.6. Third Parties in Connection with Certain Corporate Transactions

If we sell all or part of our business, transfer assets, or otherwise become involved in a change of control transaction, or in the event of bankruptcy, we may transfer or share information from or about You with one or more third parties as part of the transaction, including as part of the due diligence process. In such case, Your Data will only be transferred or shared as an integral part of the underlying transfer of the Seezi Service (or part thereof) and will not be sold separately to third parties.

4.7. When Sharing of Your Data is Approved or Accepted by You or When You Instruct Us to Share It

  • When You Use Features of the Seezi Service: Certain features of the Seezi Service may allow You to share videos through our Video Player, along with any information You choose to share. For example, You may choose to share videos through Your own websites, applications or social networking channels, such as Meta or X. If You have an account with Meta or X, You may choose to share information about a video on the Seezi Service with Meta or X users through a special sharing feature on Our Service. Such sharing is only possible while You are logged in to Your Meta or X accounts. Your decision to share information about a video on the Seezi Service may result in Seezi sending relevant information about You to Meta or X. Meta and X may process Your Personal Data in connection with the sharing of such video in accordance with their own data and privacy policies and Your Meta and X privacy settings.
  • When you contact our support service: In order to provide you with the assistance you have requested, we may need to share your information with third parties. For example, if you claim that a video available on the Seezi Service violates your rights, we may pass on your contact information to a User who uploaded that video.
  • When you agree to this: e.g. if you agree to participate in market research, respond to a survey, participate in a sweepstakes or similar activity, we may share your information with third parties as described in the applicable notice.
  • When we receive a request from a third party to exercise their legal rights: For example, if your content contains third party Personal Data, we may provide your contact information to enable them to exercise their legal rights in accordance with our Terms of Use. We would like to remind you that you are the Data Controller of the Third Party Personal Data contained in your content. For example, where images of your friends are shown in your video, this is their personal data and you are the Data Controller of your friends’ personal data. As the Data Controller, you have a legal obligation to respond to requests to exercise their privacy rights. Therefore, if we receive a request to delete your video because it contains Third Party Personal Data (or a similar request), we will communicate this to you, inform the requesting party that you are the Data Controller of their Personal Data and provide your contact information.

 

5.  DATA SECURITY AND ACCOUNT ACCESS

5.1. Data Security

The security of your data is important to us. Our goal is to ensure that you feel safe and secure when using the Seezi Service.

We use a variety of physical, technical, and administrative measures to protect the information we hold against loss, theft, and unauthorized use, disclosure, and alteration. For example, we take steps to limit access to sensitive information only to Seezi employees, agents, and contractors who have a legitimate business reason to access that information. We also use measures such as encryption and hashing to help protect sensitive information during transmission, and firewalls to help prevent unauthorized persons from accessing your Personal Data. We also use techniques such as data aggregation to make it more difficult to link and trace information to You.

Despite these efforts, there is always the possibility that a breach of data transmission or storage may occur. We want you to be confident in our security when using the Seezi Service, but  we cannot always guarantee absolute security of the Data  . We recommend that you be careful and use a unique and complex password for your Seezi account, i.e. a password that you do not use for any other service where you have an account (this can prevent unauthorized access to these other accounts in the event that your Seezi password is compromised), change your password if you suspect fraudulent use, and contact us if you notice any suspicious activity on the Seezi Service. As a good practice, we recommend that you use a dedicated email address as your Seezi Service credentials, thus limiting the potential impact of its disclosure in the event of a data breach.

We remind you that Seezi is a content hosting platform and not a content storage service, and you are responsible for maintaining copies of all Content you upload to our Service.

5.2. Account Access

If you have an account with us, your Personal Data can be reviewed online within your account settings. You can also update your information through your account settings or by contacting us ( see Section 11.5 “Contact Us” for more details  ).

Your account is personal to you and is protected by a user-created password. We recommend that you choose a unique and complex password, not disclose it to third parties, and change it if you have any concerns about its confidentiality. If you observe any suspicious activity on your account, do not hesitate to contact us. If you use a third-party sign-in solution (e.g. Google), please note that Seezi does not store or manage your password. Instead, it is the policies of the third-party sign-in solution that apply to the management of your password.

If you allow others to use your account (including allowing others to establish certain access to your account), they may be able to view information associated with your account (such as your email address) or any of the playlists created in your library (such as videos you have watched). You should exercise caution when processing and disclosing your Personal Data on our Service and avoid sending it via unsecured email. For more information on how to protect yourself from identity theft, please  see the Federal Trade Commission's website.

6.  DATA STORAGE

Data is stored electronically on Seezi servers or our cloud service providers and is retained only for as long as necessary for the purposes set out in this Privacy Policy or as required by applicable law.

In particular, you may close your Seezi account and delete any of Your Content at any time. We may also proceed with its deletion in accordance with our inactive account and inactive content policies.

We have a legal obligation to retain certain Data, such as information relating to the identity of anyone uploading content or billing details. If you ask us to delete your Data, the Data will be deleted or anonymized and used for statistical purposes only, provided that its retention is not required or authorized by applicable law. For more information about your rights in relation to your Personal Data, please  see Section 8 below.

7.  YOUTH RESTRICTIONS AND PARENTAL CONTROL

Children who are under the legal age to contract with a digital service provider in their country of residence are defined in this Privacy Policy as “  Minors  ” and are not permitted to register with Seezi, i.e. they are not permitted to open an account on our Service.

The age limit that determines whether a person is a Youth is determined by the laws of your country of residence and generally ranges from 13 to 16 years of age.

Additionally, Teens should not use or access our Service without the involvement and consent of a parent or guardian.

The Seezi Service is for the general public. It does not specifically cater to any particular age or interest group. When you visit our Service without signing in, we do not know your age. Although we do not have this information, we have designed certain Service features that protect younger audiences. In particular, parental controls are enabled by default when using our Service.

If you are the parent or legal guardian of a Junior and that Junior has somehow registered with Seezi without your consent and in violation of our Terms and Conditions, please   contact the Seezi support team, available 24/7, through the Seezi Help Center  to initiate an account deletion procedure. When submitting your request, please provide us with a sworn statement confirming that you are a parent exercising full parental rights or a legal guardian of the child, and include your full name and address, the child's full name and address, your relationship to the child, and your email address. Seezi will use this information only to process your request and verify that you are the parent or legal guardian of the child, and for no other purpose.

8.  YOUR PRIVACY RIGHTS

8.1. General

Depending on your country of residence, you may have the right to access, correct and/or delete the Data you have provided to us by making a request through your account settings or   by contacting the Seezi Help Center   through the dedicated section. Where justified by the circumstances of your request, we may ask you for a copy of your ID or other relevant documentation to confirm that you are in fact the data owner or a person authorized to exercise these rights on behalf of a data owner and to determine the laws and procedures applicable to your request.

If you reside in the European Economic Area, the United Kingdom, Switzerland, California, Brazil, Korea or Türkiye, you can find specific information and procedures that apply under the laws of your country of residence in this Section (Sections 8.5 to 8.9).

8.2. Changing Privacy Settings for Promotional Communications

You may decide not to receive promotional communications from Seezi by accessing your account settings. You may also notify us of your decision not to receive promotional communications by clicking on the "unsubscribe" link in a particular promotional message.

Please note that you cannot opt ​​out of receiving administrative messages, service announcements, and messages regarding your account terms and conditions, as they may contain important information necessary to use the Seezi Service.

You can choose to receive push notifications from Seezi on your device. If you do not want to receive push notifications, you can use your device settings to turn them off.

8.3 Choices for Third Party Online Behavioral or Interest-Based Advertising on Websites (Including Mobile Websites)

Seezi offers its users the ability to make choices about the use of their information for ad targeting. To learn more about how your ad preferences can be exercised, please  see our Cookie Policy  .

Some of the third parties that collect or participate in the collection of information about or from You on Seezi participate in the DAA Self-Regulatory Program for Online Behavioral Advertising. This program provides a centralized forum where individuals can express their choices regarding the use of their information for online behavioral advertising. Please note that if you opt out of online behavioral advertising using this method, that choice will only apply to the specific browser or device from which you opt out and only to companies that participate in the "YourAdChoices" initiative.

In addition, some of these third parties may be members of the Network Advertising Initiative ("NAI"), a cooperative of online marketing companies that offers a centralized means to opt out of interest-based advertising offered by each of its member companies. If you would like to learn more about interest-based advertising and the NAI, and to make choices regarding the use of information about or about You on its members' websites, please  click here  . Please note that if you opt out of interest-based advertising using this method, that choice will apply only to the specific browser or device from which you opted out and only to companies that participate in the NAI initiative.

8.4 Choices for Third Party Online Behavioral or Interest-Based Advertising in Mobile Applications

You can define your preferences regarding the use of your information or ad targeting in mobile applications by accessing the cookie preference module, which you can access directly within the settings of Seezi's mobile applications.

Some of the third parties that collect or participate in the collection of information from or about You on the Seezi Service participate in the DAA Self-Regulatory Program for Online Behavioral Advertising. This program offers a mobile application called "AppChoices" that provides a central location where users can make choices about the use of their information for online behavioral advertising in a mobile application environment. The AppChoices application can be downloaded from your mobile device  at https://Youradchoices.com/appchoices  or from your device's app store. Please note that if you opt out of online behavioral advertising using this method, that choice will apply only to the mobile device you use to do so and only to companies that participate in the AppChoices initiative.

You may also exercise your preferences by accessing your device settings and selecting “Limit Ad Tracking” (for iOS devices) or “Opt Out of Interest-Based Ads” (for Android devices), which allows you to limit the use of information collected from or about your mobile device (for example, precise location data) for the purpose of serving you online behavioral ads.

8.5 Additional Information for EEA Residents

8.5.1. Rights of Data Owners

Individuals located in the European Economic Area (i.e. the European Economic Area, the United Kingdom and Switzerland) have certain legal rights in relation to their Data  which they may exercise vis-à-vis Data Controllers, i.e. the organisations responsible for the processing of their Data.

  • Rights of Data Subjects Where Seezi Acts as Data Controller: Subject to legal exemptions, if you reside in the EEA,  you have the right to request from Seezi SA  access, update, erasure, rectification or transfer of your Personal Data that Seezi SA processes in its capacity as Data Controller. You can do this by using the settings and tools provided in your Seezi account or by contacting Seezi SA. If you have problems using the settings and tools or if you do not have a Seezi account, please  contact the Seezi Help Center via the dedicated section  or send an email to the attention of our Data Protection Officer at the following address: support@seezi.net . Please include in your request a clear description of your request and information regarding your country of residence, your Seezi account (such as the email address used to log in to this account) or any information that allows us to identify and authenticate your Data.

Depending on the nature of your request, you may be asked to provide additional documentation if needed to verify your identity and the compliance of your request with legal requirements and to identify the Personal Data to which your request relates.

You also have the right to define and inform us of the rules that apply to your Data in the event of your death.

Please note that, in accordance with applicable law, some of your Data may not be communicated, corrected or deleted despite your request. In this case, we will inform you of our inability to fully comply with your request and the reasons behind this decision.

  • Rights of Data Subjects When Seezi Is Not Acting as a Data Controller: We would like to remind you that when using the Seezi Service, your Data may be Processed by different entities acting as Data Controllers. If we receive a lawful request from you regarding Data processed by another Data Controller (i.e., which allows us to identify the Data Controller and reasonably establish that it is provided by a person whose Personal Data is being processed), we will, if reasonably possible, forward the request and your contact information to that Data Controller and inform you accordingly.

In particular,  if your Personal Data is present in Content available on the Seezi Service, the Data Controller of your Personal Data is the User who uploaded the Content in question, while Seezi’s role is that of the Data Processor . In accordance with the GDPR, data subjects must address their requests to a Data Controller, i.e. the User who uploaded the Content in question. Therefore, if we receive a request to delete a video showing your Personal Data (e.g. a recording of you), we will address this to the User who uploaded the video in question, i.e. the Data Controller. The User in question will have one month to respond (with the possibility of extending this delay by another month). Only in the absence of such a response, i.e. when a Data Controller  fails to respect its legal obligation to respond to a data subject request  , Seezi may disable access to the video in question. As a content hosting platform, we have an obligation to disable access to content that is clearly illegal. The presence of Personal Data in the Content is not illegal per se. However, the absence of a response from a Data Controller constitutes a failure to comply with a legal obligation. It is this disrespect that makes the content illegal and triggers Seezi to block access to it on our Service.   

During the processing of your request by the Data Controller (i.e. Uploader), your Content will remain accessible on our Service, unless the Personal Data contained therein belongs to a category of sensitive Personal Data (e.g. health data) or belongs to a minor. In this case, we will temporarily block access to the Content while awaiting the Data Controller's decision, as this type of Personal Data requires a higher level of protection.

8.5.2. Data Privacy Framework

Your Personal Data may be processed by Seezi, a wholly owned subsidiary of Seezi. As of the date of publication of this latest version of our Privacy Policy, Seezi is registered with the Data Privacy Framework ("DPF") and has committed to complying with the standards set forth in the processing of Personal Data of data subjects of the European Economic Area, Switzerland and the United Kingdom. With respect to Personal Data received or transferred pursuant to the Data Privacy Framework, Seezi is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. Seezi accepts its possible liability in the event of transfer of Personal Data to Third Parties. You can regularly verify Seezi's self-certification  with the DPF by consulting the list of its participants available here  . If you have a question regarding the data covered or wish to make a complaint, please contact Seezi, whose contact details are provided in the "Contact Us" section of this Privacy Policy. Please include in your request a copy of your ID, information regarding your country of residence and all information that allows us to identify your account on the Seezi Service. Seezi will respond to you within 30 days.

If you are not satisfied with Seezi's final decision regarding your complaint, you may use the other appeal venues defined in the DPF. In particular, if your appeal rights to Seezi have been exhausted, you  may submit your complaint to the body declared by Seezi as competent for dispute resolution purposes in the DPF, namely the EU Data Protection Authorities, the Swiss FDPIC or the UK Information Commissioner's Office (ICO)  , and if you are not satisfied with the decision of this body, you may use the arbitration procedure provided under the DPF. 8.6 Additional Options for United States Residents

8.6.1.a. Personal Data Processing Information Under California Privacy Laws
8.6.1.ai General

If you are a California resident, in addition to other information you may find in this Privacy Policy, this section  is intended to provide you with certain information required under the California Consumer Protection Act (" CCPA "), as amended by the California Privacy Rights Act (" CPRA "), collectively  referred to as the " CCPA ". If you have an account with Seezi, we identify you by the email address you use to log in or other credentials that may be used for sign-in purposes from time to time. However, if you do not have an account, in most cases we rely on a unique online identifier to identify and recognize you.

When you access our Service, a Seezi cookie (i.e. a small text file) is dropped on your device’s browser. If you use different devices or different Internet browsers to access our Service (and unless you do so as a logged-in user, in which case we can recognize you regardless of the device or browser used), you will be assigned a different Service ID for each of your device/browser combinations. In other words, if you first accessed the Seezi Service using Firefox on your laptop, but later visited on your phone using Chrome, you will appear to us as two separate users. Unless you access the Seezi Service as a logged-in user, any information we may have about you will be appended to this Service ID.

Due to the legal rules applicable to our activities, our cookies have a lifespan of 13 months. Once the 13-month period has expired, the Seezi cookie that stores your Service ID will expire. The cookie may also be deleted before the end of this 13-month lifespan; for example, it may be deleted intentionally by you or through your browsing settings. If you continue to use our Service, a new Seezi cookie will be dropped on your browser and you will be assigned a new Service ID. 

As previously stated in this Privacy Policy, we do not cross-reference the Service IDs assigned to you on our Service. Unless you are a logged-in user (in which case we will recognize you by your account credentials regardless of the number of Service IDs generated for you), each new Service ID represents a new user to us. Therefore, and as long as you are not a logged-in user, if you decide to exercise any of your CCPA rights, your decision will apply only to the Service ID by which we recognize you. In particular  , if you use the Seezi Service on multiple devices or Internet browsers, your decision to Opt Out of Sale and Sharing of Your Personal Information must be expressed on each such device or browser  .

8.6.1.a.ii. Collected PI:  Collection, Disclosure, Sale and Sharing.

We may collect Personal Information from You (directly or indirectly), the Seezi Companies, or companies with whom we have a business relationship. We collect Personal Information directly from You when You create an account or otherwise communicate with us or interact with our Service. We collect or generate information about You when you use our Service. Some of the Personal Information we collect may be in the category of Sensitive Personal Information ("  SPI  "). We collect Personal Information from companies with whom we have a business relationship, for example, when we hire them to help us operate our Service. Your Personal Information may be shared with and by the Seezi Companies when they are involved in operating our Service or when You use their services.

Additionally, certain PIs may be disclosed to us by our advertising partners who wish to advertise on our Service for the purpose of enabling the delivery of advertisements.

We disclose your Personal Information to our Service Providers, Contractors, and Third Parties. When this disclosure is done for monetary or other valuable consideration, it is referred to as a Sale under the CCPA. Note: Seezi Player is available on Seezi digital properties and third-party digital properties (e.g. websites). When our Player is embedded on a third-party website, for technical reasons, we use the URL of that website to serve ads and Content. In general, URLs do not reveal any of your SPI. In rare cases where full URLs may suggest your SPI (e.g. when you visit a website for a religious community, its URL may suggest your religious beliefs), please note that Seezi does not use this SPI. Full URLs are used by us for technical purposes, including displaying Content or ads, ensuring security, and debugging, without us analyzing the actual content of the URL.

The CCPA defines "Sale" of PI as any sharing, renting, releasing, disclosing, disseminating, making available, transferring or otherwise communicating, whether verbally, in writing, electronically or otherwise, a consumer's PI to a third party for monetary or other valuable consideration by a Business. When your PI is communicated in this manner for Cross-Context Behavioral Advertising, such communication is referred to as Sharing.

Seezi does not knowingly Sell or Share personal information of minors under the age of 16.

As part of our business activities, we may sell and share your Personal Information with third parties, advertisers or technology companies we partner with. When you use our Service, our advertising partners collect Personal Information about you, such as digital identifiers (e.g., online identifiers, IP address), activity history (how you interact with their ads), and electronic information (e.g., which browser you use) to display their ads to you. These companies may use such information to help us conduct our business activities (in doing so, they become our Service Providers) and for their own business purposes, including personalizing the ads you see on and off our Service. Targeting ads based on your Personal Information obtained from your activities across different businesses, distinctly branded websites, applications or services is referred to as "  Cross-Context Behavioral Advertising  " under the CCPA. When our advertising partners engage in Cross-Context Behavioral Advertising (i.e., use your Personal Information collected on our Service and other websites and services to display ads to you on and off the Seezi Service), our disclosure of your Personal Information to them constitutes a Share of Your Personal Information.

Please note that there is no Sharing of your PI when the ads you see on our Service are targeted using only PI collected on the Seezi Service. As a result, if you Opt Out of the Sale or Sharing of your PI, you will continue to see ads on our Services and those ads may continue to be tailored to your interests, but may be less precise because they will be based solely on PI collected while you are using the Seezi Service. Your PI may continue to be disclosed to other entities, but they may use it only for Seezi’s business purposes and pursuant to a written agreement we have with them.

8.6.1.a.iii. Storage Period of PI

Your personal data is stored for as long as it is needed to fulfill our business purposes, for example, for the performance of a contract we have with you, for compliance with legal obligations, or for the establishment, exercise or defense of legal claims. When it is no longer needed for the purposes described above, it is deleted, aggregated, de-identified or anonymized. For each type of data and process, we determine retention timeframes according to the purpose for which it was collected and ensure that it is not stored for longer than necessary.

8.6.1.a.iv.  Automated Decision Making

Seezi uses algorithms to improve our Service. For example, we use algorithms to create more relevant search results when you use our search engine or to suggest content that we think you may be interested in. We also use algorithms to infer certain information about your use of our Service. This information may include your age range or gender. We use this inferred information to provide you with a more personalized experience.

8.6.1.av California Consumer Rights

If you are a California resident, you have the right to know what PI we have collected about you, including the categories of PI we have collected about you, the categories of sources from which your PI was collected, the business or commercial purpose behind our collection, the sale or sharing of your PI, and the categories of third parties to whom your PI may be disclosed. You may request access to your PI that we have collected or otherwise obtained in our records during the 12-month period preceding your request (including obtaining a portable format copy of your PI) or to request deletion of your PI or correction of inaccurate PI. You also have the right to instruct us not to sell or share your PI with third parties and to limit the use and disclosure of your SPI if your SPI is used other than to provide our Service to you or as authorized under the CCPA (which Seezi does not currently do).

You may exercise any of these rights directly or through an authorized agent. If you wish to make a request regarding your Personal Information through an authorized agent, you must provide such agent with written consent specifying the right you wish to exercise, and you must provide such consent to Seezi, along with copies of your and your agent’s government-issued identification at the time of making the request. We may request additional documentation or information as we deem necessary to determine whether your request meets the legal standards of a verified request (i.e., to establish that the consumer making the request is the consumer from whom Seezi collected Personal Information or, if such consumer is under 13 years of age, the consumer’s parent or legal guardian), to verify the agent’s authority to act on your behalf, the scope of the authorizations you have granted, and to identify your Personal Information.

Your choice to exercise any of the rights listed above will not result in any discriminatory treatment, whether in relation to your use of the Seezi Service or Secondary Websites.

  • 8.6.1.av1. Right to Opt Out of Sale or Sharing of Personal Information and Limit Use and Disclosure of SPI

You have the right to "opt out" of the Sale or Sharing of your Personal Information, which means you can tell a business to stop Selling or Sharing your Personal Information and to refrain from Selling or Sharing it in the future. Exercising your right to opt out will not affect your Personal Information that has already been Sold or Shared.

To exercise this right, click on the "Do Not Sell or Share/Process My Personal Information for Targeted Ads" link on our Service (in the footer of our website and in the settings of our app). If you access our Service through our Player embedded in third-party websites or apps or using a small-screen device, you may see a different link. For technical reasons, due to available space,   you may see shorter text such as   " Do Not Sell/Share/Use My Information for Targeted Ads  " or "  Opt Out of Sell/Share/Targeted Ads ".

Please note that the Opt-Out link may not be visible or functional if you access our Service using an IP address outside of California  (for example, when accessing the Seezi Service from a different state or country or when using location masking technologies such as proxy or VPN (Virtual Private Network) software). If you are a California resident and encounter issues exercising your Opt-Out right, for example, if you are not physically located in California at the time, we ask that you contact us directly using one of the contact methods listed in Section 8.6.1.viii.

When available, you may also use a so-called “opt-out signal,” a scanning technology that meets the standards set forth by the CCPA, which allows you to opt out of the Sale or Sharing of Your PI with all businesses You interact with online using a particular device and browser; you do not have to exercise this option with each business individually. While we provide You with the ability to opt out of the Sale and Sharing of Your PI, please note that implementation of this opt-out signal may not be seamless and may require additional interaction from You.

If a transaction that requires your personal information to be shared or sold has a specific scope, for example if it is limited in time or concerns a specific category of data, we may offer you a specific opt-out option to ensure transparency of our transactions.

When you exercise your right to opt out, we will stop selling and sharing your personal information. In particular, we will refrain from disclosing it to Third Parties for their own business purposes.

Please note that when you exercise your Opt-Out right, We will not Sell or Share Your Personal Information, but We may disclose such information to our business partners to help us conduct our own business activities. Under these circumstances, our business partners will act as our Service Providers or Contractors and will not be permitted to use your Personal Information for purposes other than those requested by us or otherwise authorized by the CCPA.

We would like to remind you that an Opt-Out decision is limited to the device and browser used . If you use our Service on different devices or via different browsers, your Opt-Out decision must be communicated to us separately on each of them and renewed each time the associated Service ID is no longer active.

In addition, if your Service ID is no longer recognized by our Service (either because the cookie in which it is stored has expired or because You or the technology You use (e.g., Your Internet browser) has deleted or disabled the distribution of that cookie), we will no longer be able to recognize You or acknowledge that You have opted out of the sale of Your Personal Information. We ask that you verify your registered choices by accessing your CCPA settings via the "Do Not Sell or Share/Process My Personal Information for Targeted Advertising" link  (or  "Do Not Sell/Share/Use My Information for Targeted Advertising  " or "  Opt Out of Sale/Sharing/Targeted Advertising  ")  and, if necessary, refresh the Opt Out procedure  .

Please note that Seezi does not use SPI for purposes other than those described in section 8.6.1.a.ii above or permitted under the CCPA. As a result, we limit our use and disclosure of your SPI to those necessary to perform services reasonably expected by an average user of the Seezi Service or as authorized under the CCPA.

  • 8.6.1.av2. Opt-In Requests After Opt-Out for Sale and Sharing of Your Personal Information

After exercising your right to opt out, you may re-opt in to the Sale and Sharing of your Personal Information. You will be notified if the Sale of your Personal Information is required to complete a transaction.

Opting out of the Sale and Sharing of Your Personal Information is an easy two-step process: You simply request to opt in, and then you will be asked to confirm your choice. You can do this by clicking on the “Do Not Sell or Share/Process My Personal Information for Targeted Advertising” link accessible in the footer of our website and in the settings of our app (or “Do Not Sell/Share/Use My Information for Targeted Advertising” or “Opt Out of Sale/Share/Targeted Advertising”) or by using any of the other contact methods described in Section 8.6.1.h below.

  • 8.6.1.av3. Right to Access and/or Erasure of Your Personal Information and/or Correction of Inaccurate Personal Information

In addition to the right to be informed about the PI we collect, disclose, share or sell (i.e. the information contained in this Privacy Policy), you have the right to request that Seezi provide you with access to the specific pieces and categories of your PI that Seezi has collected, disclosed, sold or shared for at least the 12 months prior to your request. This request may only be made once every 12 months.

You also have the right to request correction or deletion of your Personal Data collected or stored by Seezi within the same 12-month period.

If requested and to the extent technically feasible, after receiving your request for access, we will provide the specific pieces of Personal Information we obtained from you in a format that is easily understandable to the average consumer, structured, commonly used, machine-readable and allows for unhindered transmission to another organization.

Once we receive your verifiable request to delete your Personal Information, we will proceed with the deletion of such information unless otherwise authorized or required by law.

8.6.1.a.vi. Methods for Submitting a Verifiable Consumer Request

In addition to exercising your right to Opt Out via the “Do Not Sell or Share/Process My Personal Information for Targeted Advertising” link accessible from the footer of our website and within the settings of our app (or “Do Not Sell/Share/Use My Information for Targeted Ads” or “Opt Out of Sale/Share/Targeted Ads”), you may submit your Opt Out, access, correction or deletion request by contacting our Support Policy Team using one of the following methods:

  •  You can make a request from the "Personal Data" section in the Seezi Help Center ;
    •  By sending an email to  support@seezi.net

At least the following information must be provided with your request:

  • Your account login information (your email address, username or other account information used to log in to your Seezi account) or Service ID(s), which you can obtain by following the instructions we will provide to you;
    • The nature of your request, i.e. which rights you wish to exercise;
    • Documents proving that you reside in California;
    • An email or physical address that we can use for further correspondence regarding your request;
    • If your request concerns you or a third party (if you are making an application on behalf of a third party, you must provide documentation proving your legal authority to do so (e.g. a signed document from the person you are requesting authorisation to state the content of the request, a copy of their official ID and yours)).

To help our Help Center team determine the applicable procedures, we strongly recommend that you reference the California Consumer Protection Act in the subject or body of your request.

Depending on the nature and circumstances of your request, you may be required to follow additional procedures (for example, obtain your Service ID by following the instructions provided by our Support Team) or provide additional supporting documentation, as necessary, to verify your identity and enable us to identify your Personal Information. 

In order to comply with a consumer’s request to access, correct, delete or disclose their PI, Seezi must first verify those requests. CCPA rights related to Your PI can only be exercised by You, meaning Your request cannot relate to PI that is not Yours and no one (unless acting as Your authorized agent) can exercise CCPA rights related to Your PI. As a result, before we can process a request, we must take reasonable steps to verify the identity of the person submitting the request to us, that person’s right to exercise their CCPA rights, and the information to which the request relates.

The actual verification process may take different forms depending on the circumstances of your request. For example, if you have a Seezi account, you may be asked to respond to a verification email sent by our Support Team to the email address you use to log in. The Seezi Support Policy team will guide you through the applicable procedures.

Your requests will be responded to within the 45-day period required by the CCPA. However, we may need up to an additional 45 days to respond to your request when reasonably necessary. We will notify you if we decide to extend the response time.

8.6.1.b Third Party Marketing Activities

If you are a California resident, you may have the right to request disclosure of the categories of PI (such as your name and contact information) we share with third parties who want to contact you or directly send you promotional information about their products and services (such as when the third party is acting on our behalf or when you provide your PI as part of a joint promotion between Seezi and the third party). You may also request the names and addresses of these third parties. Please note that you may only make these requests once per calendar year.

If you are a California resident and would like to request a copy of this information regarding our disclosure of our PI to third parties for their direct marketing purposes in the immediately preceding calendar year, please contact us using the procedure described in Section 8.6.1.a. (viii) or send us an email at support@seezi.net.

8.6.1.c. Special Rules Applicable to the Deletion of Information Published by Minors

If you are a California resident under 18 years of age and a registered user of the Seezi Service, you may request and obtain removal of Content or information you have publicly posted on the Seezi Service. To make this request, please   contact the Seezi Help Center  and provide a detailed description of the specific content or information you wish to remove and confirmation of your country and state of residence. Please note that this removal does not guarantee complete or comprehensive removal of Content or information posted by you on the Seezi Service, as there may be cases where the law does not require or permit removal.

8.6.2. Additional Information and Choices for Residents of U.S. Privacy Act States other than California

In addition to other information you may find in this Privacy Policy, and specifically the description of how Seezi may process your Personal Information (" PII ") provided in Section 8.6.1 "Additional Choices for California Residents"   , this section is intended to provide you with certain information that may be required under the local privacy laws of your state of residence.

Each state law provides different definitions of key terms used in relation to the processing of PI. For example, when PI is disclosed to third parties for cross-context targeted advertising (i.e., information collected when you use different services serves to personalize the ads you see on our Service), California law refers to this as “Sharing,” while Virginia law uses the term processing for “Targeted Advertising.” Additionally, each state law independently defines the date on which You become eligible for the rights provided to You. We recommend that you consult the applicable state laws for the exact definitions of different privacy-related terms and the effective date of the rights You are eligible for.

Unless otherwise specified in this Section 8, all references to Sharing under Section 8.6 refer to the processing of PI for Targeted Advertising purposes. Any other terms have the meaning assigned to them independently under each applicable state privacy law.

8.6.2.a. Residents of U.S. Privacy Law States

We would like to inform you that Seezi does not process your PI for profiling purposes in furtherance of decisions that lead to legal or similarly significant effects concerning consumers. Seezi may disclose your PI in a commercial context, in particular when providing personalized advertising.

For information on how Seezi may process your Personal Information, please see section 8.6.1.

Such reports contain aggregate information that is not intended to directly identify you.

Seezi finances its business from advertising revenues. Advertising is an essential part of our Service. As a result, we may process your Personal Information to show you advertisements that we believe may be of interest to you. We may also share your Personal Information with third parties for Targeted Advertising purposes. In such cases, your Personal Information about your use of the Seezi Service will be combined with information about your use of other services by these third parties to select advertisements that we believe will correspond to your interests. You have the right to opt out of the processing of your Personal Information for Targeted Advertising purposes by exercising your preference directly on our Service, by following the "Do Not Sell/Share My Personal Information or Targeted Ads" link (or by embedding the Seezi Player on third-party websites or applications, or by "Do Not Sell/Share/Opt Out of Targeted Ads" if you are accessing our Service using a small-screen device), or  by contacting our Customer Service  . The Opt-Out links are accessible in the footer of our website and in the settings of our application. If you access our Service from outside your state of residence, they may not be available or functional. Opt-Out will not stop advertising, but the ads you see may be less relevant because they will be based only on information we obtain from your use of our Service.

If you wish to exercise any of the rights granted under your state’s privacy laws (for example, the right to opt out, the right to be informed, the right to access, the right to rectification, the right to erasure of your personal information, or the right to data portability),  you may contact Customer Service  by specifying your state of residence and the right(s) you wish to exercise. If you reside in a state that provides an objection procedure and you disagree with our response to your request,  you may object by submitting an objection request to Customer Service  , including the original request and the response provided by Seezi. Your objection will be reviewed by a specialized team that is different from the team that provided the original response. If you wish to appeal the objection decision, you may do so by filing a complaint with your state Attorney General’s Office.

Depending on your state of residence, our response time to your initial and appeal requests ranges from 45 to 60 days, although this may be longer given the complexity of your case and our workload.

Please note that exercising your rights will not result in any discriminatory treatment by Seezi. For further details on how to exercise your rights, please see Section 8.6.1.(a)(vi). “Methods for Submitting Verifiable Consumer Requests.”

8.6.2.b.  Residents of the state of Nevada

If you are a Nevada resident, please note that Seezi does not currently sell personal data, as that term is defined by Nevada privacy laws. However, if you are a Nevada resident, you may still exercise your right to opt out of the sale under Nevada Revised Statutes §603A et seq. by  contacting our Customer Service indicating your state of residence.

8.7. Special Information and Rights Applicable to Residents in Türkiye

If you reside in Türkiye, the following special conditions apply to you:

Seezi may process the Data listed in Section 2 for the purposes described in Section 3, based on the following legal grounds:

  1. processing is expressly prescribed or required by law;
  2. The processing of your data is necessary provided that it is directly related to the conclusion or performance of your contract with us;
  3. processing is necessary for us to fulfil our legal obligations;
  4. The relevant data is made public by You;
  5. processing is necessary for the establishment, exercise or protection of a right;
  6. Processing is mandatory for our legitimate interests, provided that it does not violate your fundamental rights and freedoms;
  7. Your explicit consent (this legal basis is used only in relation to transactions that require your consent and not for any transactions that may be carried out on the basis of another legal basis).

In accordance with the privacy laws in force in Türkiye, you have the following rights regarding your Data:

  1. The right to learn whether your data is being processed;
  2. the right to request information regarding such processing;
  3. The right to learn the purpose of processing your data and whether it is used for this purpose;
  4. Your right to know the third parties to whom your data is transferred, within or outside your country;
  5. Your right to request correction of your data if it is incomplete or incorrect;
  6. your right to request the erasure or destruction of your Data in accordance with applicable law;
  7. Your right to request that the operations carried out within the scope of clauses (v) and (vi) be notified to third parties who receive your Data from us;
  8. Your right to object to the consequences of your data being analyzed solely by automated means;
  9. Your right to claim compensation if you suffer damage due to the unlawful processing of your data.

8.8. Specific information and rights applicable to Brazilian residents

Seezi may process the Data listed in Section 2 for the purposes described in Section 3, based on the following legal grounds:

  1. approval;
  2. compliance with a legal or regulatory obligation;
  3. execution of public policies (applies only to public administration and when public policy is determined by law or regulation or supported by contracts, agreements or similar means);
  4. for studies conducted by research organizations;
  5. performance of a contract or preliminary procedures relating to a contract (the data subject must be a party to this contract);
  6. orderly exercise of rights in litigation or in administrative or arbitration proceedings;
  7. protection of life or bodily safety;
  8. protection of health (applies only to procedures performed by health professionals, health services or health authorities);
  9. the legitimate interests of the controller or of a third party; and
  10. credit protection.

Seezi may share Data with the following third party data recipients:

  1. Our service providers acting as processors,
  2. Our partners acting as independent auditors,
  3. Competent public authorities,
  4. Seezi's processors perform the processing according to the instructions provided by us and are responsible for such processing.
  5. Independent controllers perform the processing autonomously. Seezi does not decide on or is not responsible for any such processing.

As a Brazilian resident, you have the right to exercise any or all of the following rights at any time:

  1. The right to have the existence of processing confirmed;
  2. Right to access data;
  3. The right to rectify Data that is incomplete, inaccurate or outdated;
  4. The right to anonymize, block or delete unnecessary or excessive Data or Data not processed in accordance with the LGPD;
  5. Right to portability of data to another service or product provider by explicit request
  6. The right to erasure of data processed with the consent of the person concerned;
  7. The right to obtain information about public and private entities with which the Data Controller shares Data;
  8. The right to be informed about the possibility of refusing consent and the consequences of such refusal; and
  9. The right to withdraw consent.

If you wish to exercise any of the rights listed above, please contact Seezi . To help our Help Center team determine the applicable procedures, we strongly recommend that you include a reference to the LGPD in the subject or body of your request and/or indicate Brazil as your country of residence.

9.  SPECIAL CONDITIONS APPLICABLE TO SEEZİ SECONDARY SITES

In connection with its core business as a content hosting platform, Seezi operates Secondary Sites aimed at professionals in the advertising industry, such as software developers who want to contribute to or use Seezi APIs, content rights holders interested in Seezi’s Partner Program, advertisers, media agencies and various actors in the marketing industry, and others who want to learn more about our offer and our company or apply for a job position. All Secondary Sites can be accessed from the Seezi Site but may be subject to different terms of use due to the specificity of their target audience.

Indeed, since Seezi's Secondary Sites are not primarily directed at Seezi Site users, the Processing purposes described in this Privacy Policy are not the same as those applicable to the Secondary Sites.

Secondary Sites may collect their visitors' Data for statistical purposes only, in particular to record the number of visits to the pages of the Secondary Sites and the behavior of their visitors (e.g. browsing time, pages clicked, videos watched or articles read, etc.).

Seezi may use different types of cookies on Secondary Sites:

  • so-called “functional” cookies, which are designed solely to make these Secondary Sites work properly or to enable you to log in using third-party sign-in tools (e.g. Google Connect) if you so choose;
  • Audience measurement and statistical analysis cookies placed by Seezi or our subcontractors who provide audience measurement services (e.g. Amplitude).

The use of these audience measurement cookies is subject to the same rules as those described in the current Privacy Policy. You can object to their use at any time by indicating your decision on the Consent Management page accessible from the footer of our Secondary Sites. You can also exercise your rights of access, modification or deletion as described in Section 8 above.

10.  INTERNATIONAL DATA TRANSFERS AND STANDARD CONTRACTUAL CLAUSES

10.1. General Information

The processing of your Personal Data takes place in and outside the EEA. When storing your data, Seezi uses its own servers as well as servers of its service providers, including cloud storage service providers. Seezi's policy is to use servers located in Europe whenever technically possible, as further explained below.

  • Storage of Content:
    • Your Content, Other Than Comments: Content is stored on servers located in the EEA owned by Seezi or our cloud storage providers, currently Amazon AWS, or other AWS servers. If you decide to make your Content available outside the EEA, an additional temporary “cache” copy of summaries of your Content may be created on servers located outside the EEA operated by our cloud storage providers. The creation of this cache copy is inherent in video delivery technology and serves to reduce latency, meaning the time between a viewer’s request to watch a video and the video appearing on the viewer’s screen, allowing for faster viewing. A cache copy is stored on servers that are geographically close to a viewer. The creation of cache copies on servers located outside the EEA will result in the transfer of your Personal Data, i.e. summaries of your Content, outside the EEA.
    • Comments: Depending on the region from which you access the Seezi Service, you may have the opportunity to comment on Content on our Service. Your comments are stored on servers in the United States used by our service provider who helps us run the comment feature.
  • Operation of the Seezi Service: Operation of the Seezi Service involves the cooperation of all companies belonging to the Seezi group. Some of these companies are located outside the EEA. As a result, Seezi entities outside the EEA may process your Personal Data outside the EEA, i.e. in the USA, Singapore or other countries where their employees operate.
  • Service Features:
    • Display of advertisements: When you are shown an advertisement, your Personal Data may be transferred outside the EEA if it is processed in that territory by an advertiser or a technical intermediary.
    • Service features other than displaying ads: The Seezi Service enables various features, e.g. storage of Content, display of Content, statistics, customer support, Content search or recommendation. The Data processed in this way is stored on servers belonging to Seezi and our service providers (e.g. cloud storage service providers, customer support, business analytics tools, etc.) and analyzed using Seezi and our service providers' tools. For example, if you have an account with Seezi, your email address is transferred to our US-based service provider who assists us with User communications.

10.2. Data Processors/Service Providers

Seezi uses the services of different Data Processors/Service Providers, the list of which  can be found in the relevant area  .

10.3. Legal Mechanisms Relied On

We may disclose your Data to third parties, including those located outside your country of residence, such as our service providers, business partners or public authorities. Seezi respects privacy rights and will seek to collect, use and disclose your Data only when strictly necessary and consistent with applicable law, including when such Data is processed outside your country of residence. In particular, Seezi transfers EEA residents’ Data to countries outside the EEA only when an adequate level of protection is provided.

Please note that the competent EEA authorities have determined a list of non-EEA countries that are considered to provide an adequate level of protection. Transfers of Personal Data to these countries do not require additional security measures. In the event that Seezi transfers Data of EEA residents to countries that are not on this list and are not otherwise authorized by applicable law, such transfer relies on the following mechanisms to ensure the security of your Data:

  • Data Privacy Framework  (for transfers to the US only) or
  •  Standard Contractual Clauses and accompanying technical measures, if any, approved by the European Commission and available here , or
  • Binding Corporate Rules in force in multinational organisations or
  • If applicable,  the exemption mechanism set out in Article 49 GDPR.

Please remember that your Content is your Personal Data and that by providing it to audiences outside the EEA, you are making your Personal Data available in those territories as well.

11.  MISCELLANEOUS

11.1. Third Party Access Points, Devices and Connections

The Seezi Service may be accessed through third-party websites, applications, and other access tools operated by other companies (collectively, "  Third-Party Access Points  "). For example, you may access the Seezi Service through third-party websites on which the Video Player is embedded. The Seezi Service may also contain links to third-party websites or applications. For example, if you click on an advertisement or search result on our website, you may be directed to a website that we do not control. None of these Third-Party Access Points, devices, websites, or applications are operated by Seezi, even if they contain our name or logo. As such, we are not responsible for the privacy practices of the operators of these Third-Party Access Points. Accordingly, we encourage you to review their respective privacy policies for more information.

11.2. Deleting Your Seezi Account

If you have an account with us,  you may choose to delete your Seezi account in accordance with our Terms of Use through your Seezi account settings when you log in  . If you are a Member of our Affiliate Program, the Program in question must be terminated before your account can be deleted. Please note that after you delete your account, you will not be able to log in to our website or access your Personal Data. However, you may open a new account at any time. If you delete your account, we will continue to retain certain information from or about you when we are required to do so under applicable law or agreements to which we are party. We may also continue to use certain Data in anonymized or pseudonymous format for various operational and analytical purposes. In addition, if certain information has previously been provided to third parties, as described in this Privacy Policy, the retention of such information will be subject to the policies of such third parties.

11.3. Applicable Law and Jurisdiction

  • If you reside in the European Economic Area, the United Kingdom and Switzerland:  unless a waiver of jurisdiction is authorized under applicable law, you agree that any dispute arising between You and Seezi arising out of or in connection with this Privacy Policy or the collection, processing and/or use of Your Data will be construed in accordance with the laws of France, without reference to conflict of laws principles and notwithstanding any multi-defendant or third-party claims. You further agree that any claim or dispute between You and Seezi will be decided by a court of competent jurisdiction located in Paris. 
  • If You reside in a country that is not part of the European Economic Area, the United Kingdom or Switzerland  : You agree that any dispute arising between You and Seezi arising out of or in any way related to this Privacy Policy or the collection, processing and/or use of Your Data will be construed in accordance with the laws of the State of New York, without reference to conflict of laws principles and notwithstanding any multi-defendant or third-party claims, unless a waiver of jurisdiction is authorized under applicable law. You further agree that any claim or dispute between You and Seezi will be decided by a court of competent jurisdiction located in New York County. 

11.4 Changes to this Privacy Policy

We may revise this Privacy Policy from time to time to reflect changes in the law or the Seezi Service or for other reasons in our sole discretion. We may do so as necessary, but in any event, the Privacy Policy will be updated at least every 12 months. Therefore, it is important to verify the effective date of the most recent update of the Privacy Policy when you visit the Seezi Site or use any of the Seezi Services to ensure that you are familiar with our most current policies and practices. If we make any material changes to this Privacy Policy, we will notify you by posting a notice on the Seezi Site.

 If you are a User or Partner, we may also send an email to the email address you last provided to us in your Seezi account settings before the material change goes into effect. Accordingly, please keep your account information, including your email address, up to date. Any material changes to this Privacy Policy will automatically become effective (i) 7 days after the revised Privacy Policy is first posted or, for users who register or otherwise opt-in within such 7-day period, at the time of registration or opt-in, as applicable, or (ii) immediately upon posting if required by applicable law.
