Welcome to Seezi!
Entrance
Thank you for using the Seezi platform and the products, services and features we offer you as part of it (collectively, the "Service").
Our Service
The service allows you to discover, watch, and share videos and other content, provides a forum where people can connect, inform, and inspire others from around the world, and serves as a distribution platform for advertisers and original content creators, both large and small. There’s a lot of information about our products and how to use them in the Help Center. Among other things, you can learn about Seezi Kids, the Seezi Partner Program, and Seezi Paid Memberships and Purchases. You can also find information about enjoying content on your TV, game console, or even other devices.
Your Service Provider
The legal entity providing the Service is Nihat Mican ("Seezi", "we", "us" or "our"). References in these terms to Seezi's "Business Partners" mean other companies within the Nihat Mican private company.
Terms and Conditions
Your use of the Service is subject to these terms, the Seezi Community Rules, and the Policy, Safety, and Copyright Policies (collectively, the “Agreement”). Your Agreement with us also includes the Seezi Advertising Policies if you provide advertising or sponsorship on the Service or include paid promotions in your Content.
Please read this Agreement carefully and make sure you understand it. If you do not understand it or do not agree to any part of it, you may not use the Service.
Who can use the Service?
Age Requirements
You may use the Service if you are at least 13 years old, but children of all ages may use the Service and Seezi Kids if enabled by a parent or guardian (where applicable).
Parental or Guardian Consent
If you are under 18, you must have the consent of your parent or legal guardian to use the Service. Please ask them to read this Agreement with you.
If you are the parent or legal guardian of a user under 18, by allowing your child to use the Service, you are bound by the terms of this Agreement and are responsible for your child's actions on the Service. You can find tools and resources to help you manage your family's experience on Seezi (and information on how to enable children under 13 to use the Service and Seezi Kids) in the Help Center .
Businesses
If you are using the Service on behalf of a company or organization, you confirm to us that you have the authority to act on behalf of such entity and that such entity accepts this Agreement.
Your Use of the Service
Content on the Service
Content on the Service includes video, audio (such as music and other sounds), graphics, photos, text (such as comments and scripts), branding (including trade names, trademarks, service marks, or logos), interactive features, software, metrics, and other materials (collectively, "Content") provided by you, Seezi, or a third party. Content may be provided to the Service and distributed by our users, and Seezi is the host of such Content. Content is the responsibility of the person or entity that provides the Content to the Service. Seezi is not responsible in any way for the content posted. Any content that violates copyright or community guidelines is the responsibility of the channel owner who uploaded the content to seezi. If the existing content violates copyrights, you are the copyright owner or does not comply with community guidelines (such as sex, gambling, etc.), the channel owner will remove the content and may terminate the channel. If you see any Content that you believe does not comply with this Agreement, for example, if it violates the Community Guidelines or the law, you can let us know.
Seezi Accounts and Seezi Channels
You may use certain parts of the Service, such as browsing and searching for Content, without having a Seezi account. However, you must have a Seezi account to use certain features. With a Seezi account, you can like videos, subscribe to channels, create your own Seezi channel, and much more. You can easily create a Seezi account by clicking on the sign up button.
Creating a Seezi channel gives you access to additional features and functionality, such as uploading videos, commenting, or creating playlists.
To protect your Seezi account, keep your password confidential. You should not reuse your Seezi account password on third-party applications. Learn more about keeping your Seezi account secure, including what to do if you detect unauthorized use of your password or Seezi account.
Your information
Our Privacy Policy explains how we process your personal data and protect your privacy when you use the Service. Seezi Kids Privacy Notice provides additional information about our privacy practices specific to Seezi Kids.
We process any audio content or audiovisual content uploaded by you to the Service in accordance with the Seezi Data Processing Terms, except when you upload such content for personal purposes or for home activities.
Permissions and Restrictions
You may access the Service as provided to you, as long as you comply with this Agreement and the law. You may view or listen to Content for personal, non-commercial purposes. You may also display Seezi videos through the embeddable Seezi player.
The following restrictions apply to your use of the Service. You are not allowed to:
- Access, reproduce, download, distribute, transmit, publish, display, sell, license, modify, alter, or otherwise exploit any portion of the Service or any Content, except (a) as specifically permitted by the Service; (b) with the prior written permission of Seezi and the relevant rights holders, if any; or (c) as permitted by applicable law;
- Circumvent, disable, forge interference with, or otherwise interfere with the Service (or attempt to do any of the foregoing), including security-related features or features that (a) prevent or restrict the copying or other use of any Content, or (b) limit the use of the Content or the Service;
- (a) Access the Service using any automated means (robots, botnets or scrapers), except as provided in Seezi's txt file, through publicly available search engines; (b) with Seezi's prior written consent; or (c) as permitted by applicable law;
- Collect or use any information that could identify an individual (for example, collecting usernames or facial images), unless such individual consents or permission is granted in accordance with section 3 above;
- use the Service to distribute unsolicited promotional or commercial content or any other unsolicited or bulk solicitation (spam);
- Encourage or cause any false measurement of actual user interaction with the Service, including by paying or offering incentives to users in order to increase the number of views, likes or dislikes of a video, or the number of subscribers to a channel, or otherwise manipulate metrics;
- Abuse any reporting, flagging, reporting, objection or re-objection process, including making false, malicious or frivolous submissions;
- Conducting contests on or through the Service that are not in compliance with Seezi's contest policies and rules;
- Use the Service to view or listen to Content for any purpose other than your personal, non-commercial use (for example, you may not publicly display video or play music from the Service); or
- You may not use the Service to (a) sell any advertising, sponsorship or promotion placed in, around or on the Service or Content, except as permitted by Seezi's Advertising Policies (such as appropriate product placements); or (b) sell advertising, sponsorship or promotion on any page of an application or website that solely features Content from the Service or where Content from the Service is the primary basis for such sale (for example, selling advertising on a webpage where the only content of value is Seezi videos).
Reservation Reservation
All rights not expressly granted to you in this Agreement remain the property of Seezi or the relevant rights holders. This means, for example, that using the Service does not give you ownership of any intellectual property rights in the Content you access (including any branding used or displayed on the Service).
Developing, Improving and Updating the Service
Seezi is constantly making changes to and improving the Service. As part of this continuous development, we may make changes to the Service (whether in whole or in part), such as adding or removing features and functions, providing new digital content or services, or discontinuing old ones. We may need to make changes to the Service or discontinue any part of the Service to make performance or security improvements, to comply with the law, or to prevent illegal activities or misuse of our systems. These changes may affect all users, some users, or even a single user. If the Service requires or includes downloadable software (such as the Seezi studio app), the relevant software may be automatically updated on your device when a new version or feature becomes available, depending on your device settings. If we make significant changes that adversely affect your use of the Service, we will provide you with reasonable notice. Except in urgent cases, such as preventing misuse of the Services, complying with legal requirements, or addressing security and usability issues. We also offer the opportunity to export your content from your Seezi Account via Seezi Export, subject to applicable laws and policies.
Your Content and Behavior
Content Upload
If you have a Seezi channel, you may upload Content to the Service. You may use your Content to promote your business or artistic endeavor. If you choose to upload Content, you must not submit any Content to the Service that is not in compliance with this Agreement or the law. For example, the Content you submit must not include third-party intellectual property (such as copyrighted material) unless you have permission from that party or otherwise have the legal right to do so. You are legally responsible for the Content you submit to the Service. The channel owner is solely responsible for the Content. Seezi has no responsibility to monitor or monitor all such Content on an individual basis. We may use automated systems to analyze your Content to help detect violations and abuses, such as spam, malware, and illegal content.
Your Granted Rights
You retain all ownership rights to your content. In short, what's yours stays yours. However, we do require that you grant Seezi and other users of the Service certain rights as described below.
License Granted to Seezi
By providing Content to the Service, you grant Seezi a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use such Content (including reproducing, distributing, modifying, displaying, and presenting) for the purpose of operating, promoting, and improving the Service. Seezi may use the Content you share in its other applications and content as it wishes, and you may not claim any rights to such Content (except for the purpose of promoting, improving, etc. your Content through other channels).
License Granted to Other Users
You also grant each other user of the Service a worldwide, non-exclusive, royalty-free license to access and use Your Content through the Service (including reproducing, distributing, modifying, displaying and presenting such Content) solely in a manner that is enabled by a feature of the Service.
License Term
The licenses granted by you continue until the Content is removed as described below. After removal, the Service ceases to operate, except for use of the Content permitted prior to your removal or as otherwise required by law. For example, removal of Content by you does not require Seezi to: (a) retrieve the Content that is currently being used by other users within any limited offline viewing functionality of the Service, or (b) delete copies that we need to retain for legal purposes.
The Right to Earn Money
You grant Seezi the right to monetize your Content on the Service (which may include advertising on the Content or charging users access fees). This Agreement does not grant you the right to receive payments. As of June 1, 2021, payments you are entitled to receive from Seezi under any other agreement between you and Seezi (including, for example, payments made through the Seezi Partner Program, Channel memberships, and Super Chat) will be considered royalties. Seezi will withhold taxes from such payments where required by law.
Removing Your Content
You may remove Your Content from the Service at any time. You also have the option to make a copy of Your Content before removing it. If you no longer have the rights required by these terms, you must remove Your Content.
Removal of Your Content by Seezi
If we reasonably believe that any of your Content (1) violates this Agreement or (2) could harm Seezi, our users, or third parties, we reserve the right to remove or take down all or part of such Content. We will notify you of our reason for our action, except when we reasonably believe that doing so would: (a) violate a law enforcement order or the law or otherwise create the risk of legal liability for Seezi or our Business Partners; (b) compromise an investigation or the integrity or operation of the Service; or (c) harm any user, another third party, Seezi, or our Business Partners. More information about notification and enforcement, including how to object, can be found on the Troubleshooting page of our Help Center.
Community Guidelines Strikes
Seezi uses a "strike" system to address Content that violates Seezi's Community Guidelines. Each strike has different restrictions and can result in your channel being permanently removed from Seezi. A full explanation of how strikes affect your channel can be found on the Community Guidelines Strike Basics page. If you believe a strike is in error, you can appeal.
If your channel has been restricted due to a strike, you must not use any other channel to bypass these restrictions. Any violation of this prohibition is a material breach of this Agreement and Seezi reserves the right to close your Seezi account or terminate your access to all or parts of the Service.
Copyright Protection
We provide information at the Seezi Copyright Center to help copyright owners manage their intellectual property online. If you believe your copyright has been infringed on the Service, please send us a notification.
We respond to claims of copyright infringement pursuant to the processes available at the Seezi Copyright Center. You can also find information on how to resolve a copyright strike there. Seezi's policies provide for the termination of access to the Service for repeat infringers in appropriate circumstances.
Account Suspension and Termination
Terminations by You
You may stop using the Service at any time. You may also delete the Service from your Seezi Account. This process involves closing your Seezi channel and removing your data with the option to first download a copy of your data.
Termination and Suspension by Seezi
Seezi reserves the right to suspend or terminate your Seezi account or your access to all or part of the Service if (a) you materially or repeatedly breach this Agreement; (b) we are required to do so to comply with a legal requirement or court order; or (c) we reasonably believe that conduct is likely to give rise to liability or harm to any user, other third party, Seezi or the Partner.
Notice of Termination or Suspension
We will notify you of the reason for Seezi’s termination or suspension, except when we reasonably believe that providing notice would: (a) violate the law or law enforcement order, (b) compromise an investigation, (c) compromise the integrity, operation or security of the Service, or (d) harm any user, another third party, Seezi or our Business Partners.
Effect of Account Suspension or Termination
If your Seezi account is terminated or your access to the Service is restricted, you may continue to use certain aspects of the Service (such as viewing only) without an account, and this Agreement will continue to apply to such use. If you believe the termination or suspension was in error, you may appeal using the form in the contact section.
About the Software in Our Service
Downloadable Software
If the Service requires or includes downloadable software (such as the Seezi Studio application), unless such software is subject to additional terms provided by a license, Seezi grants you a personal, worldwide, royalty-free, non-transferable, and non-exclusive license to use the software provided to you by Seezi as part of the Service. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Service as provided by Seezi and as permitted by this Agreement. Except where such restrictions are prohibited by law or you have the written permission of Seezi, you are not permitted to copy, modify, distribute, sell, or lease any portion of the software or reverse engineer or attempt to extract the source code of the software.
Open Source
Some of the software used in our Service may be provided under an open source license that we make available to you. An open source license may contain terms that expressly override some of these terms, so please make sure you read them.
Other Legal Terms
Guarantee
We provide the Service with reasonable care and competence.
Disclaimer
By law, consumers have certain rights that cannot be excluded or modified by contract. Nothing in this Agreement affects those rights that you may have as a consumer. Except as expressly set forth in this Agreement or required by law, Seezi makes no specific promises regarding the Service. For example: the Content provided through the Service; we make no promises about any specific features of the Service or its accuracy, reliability, availability or ability to meet your needs; or that any Content you submit will be accessible or stored on the Service.
Limitation of Liability
All users: Nothing in this Agreement is intended to exclude or limit any party's liability for death or personal injury, fraud, misrepresentation or any other liability that cannot be excluded or limited by law.
To the extent permitted by applicable law, Seezi and its Partners shall not be liable for:
- Losses not resulting from Seezi or its Business Partners’ breach of this Agreement;
- any loss or damage that was not a reasonably foreseeable consequence of Seezi or its Business Partners’ breach of this Agreement at the time this Agreement was formed between you and Seezi; or
- any Content posted by any user or any defamatory, offensive or unlawful conduct of any user.
Business Users Only: If you use the Service for the purpose of your trade, business, craft or profession (if you are a “Business User”), the following limitations of liability also apply to the extent permitted by applicable law:
- Seezi and its Partners are not liable for any loss of profits, revenues or data, loss of opportunity or loss of anticipated savings, indirect or consequential losses or punitive damages (in each case, regardless of whether such losses were foreseeable or not);
- Seezi's and its Business Partners' total liability for claims arising out of or in connection with the Service is limited to the greater of: (a) the amount of revenue Seezi has paid to you through your use of the Service in the 12 months prior to the date of your written notification to Seezi regarding the claim, and (b) ₺500.
Third Party Links
The Service may contain links to third-party web sites and online services that are not owned or controlled by Seezi. Seezi has no control over, and Seezi assumes no responsibility for, such web sites and online services. Please note that when you leave the Service, we encourage you to read the terms and privacy policies of each third-party web site and online service that you visit.
About This Agreement
Changing This Agreement
We may modify this Agreement, for example (1) to reflect changes to the Service or the way we operate (like when we add new products or features or remove old ones), (2) for legal, regulatory or security reasons, or (3) to prevent abuse or harm.
If we make material changes to this Agreement, we will give you reasonable notice and an opportunity to review the changes, except in urgent cases such as (1) when we release a new product or feature, or (2) to prevent continued abuse or to meet legal requirements. If you do not agree to the new terms, you must remove all Content you have uploaded and discontinue using the Service.
Continuation of the Agreement
In the event that your use of the Service is terminated, the terms of this Agreement titled "Other Legal Terms" and "About This Agreement" will continue to apply to you. In addition, the licenses granted by you will continue in the limited circumstances described under "License Term".
Divisibility
If any term of this Agreement is unenforceable for any reason, it will not affect the other terms.
Assignment
Seezi may assign all or part of this Agreement to a Business Partner or to a third party in the event Seezi is sold.
No Waiver
If you fail to comply with this Agreement, our failure to take immediate action will not mean that we have waived any rights we may have (such as the right to take action in the future).
Applicable Law
This Agreement and your relationship with Seezi under this Agreement will be subject to the laws of the relevant center and legal disputes may be resolved by applying to its courts.
If mandatory local laws prohibit a dispute under this Agreement from being resolved in Turkish courts, disputes may be brought in your local courts. If mandatory local laws prohibit a local court from applying Turkish law to a dispute under this Agreement, the dispute will be resolved in accordance with the laws of your country of residence.
Valid as of January 5, 2022.
In case of translation of all or part of the Terms of Use, you acknowledge and agree that only the Turkish version of this Privacy Policy will be valid in all cases, including cases where such a translation is provided by SEEZİ (due to possible translation errors).
